1. Acceptance of Terms

Welcome to Khelamm.

These Terms and Conditions ("Terms") govern your access to and use of the Khelamm website, mobile applications, and related services (collectively, the "Services") operated by Khelamm ("Khelamm", "we", "our", or "us").

By creating an account, accessing, or using the Services, you agree to be bound by these Terms.

If you do not agree to these Terms, you must not use the Services.

2. About Khelamm

Khelamm is a community-driven platform that enables users to:

  • Discover sports and recreational games

  • Join games hosted by other users

  • Apply to become hosts

  • Organize and manage games for community members

Khelamm acts solely as a technology platform that connects players and hosts.

Khelamm does not organize, supervise, manage, operate, sponsor, control, or participate in games listed on the platform.

All games are independently organized and managed by hosts.

3. Eligibility

To use Khelamm, you must:

  • Be at least eighteen (18) years of age

  • Provide accurate and complete information

  • Comply with these Terms and applicable laws

Khelamm reserves the right to suspend or terminate accounts that do not meet these requirements.

4. User Accounts

Users are responsible for:

  • Maintaining accurate account information

  • Protecting account credentials

  • All activities conducted through their account

Users may not:

  • Share accounts with others

  • Create accounts using false information

  • Impersonate another person or organization

  • Create multiple accounts for deceptive purposes

  • Use Khelamm for unlawful activities

Khelamm may suspend, restrict, or terminate accounts at its discretion for violations of these Terms.

5. Host Verification

Users wishing to host games may be required to complete identity verification.

Khelamm may request government-issued identification documents to verify a host's identity.

Providing false, inaccurate, or misleading information during verification may result in suspension or permanent removal from the platform.

Verification does not constitute an endorsement, certification, guarantee, or warranty by Khelamm regarding any host.

6. Host Verification and Trust & Safety

Khelamm may require identity verification for users applying to become hosts.

Verification is intended solely to enhance community trust and safety and does not constitute an endorsement, certification, guarantee, or warranty of any host.

Khelamm does not guarantee:

  • The character of any host

  • The conduct of any host

  • The quality of any hosted game

  • The safety of any venue

  • The accuracy of information provided by hosts

Users remain responsible for exercising their own judgment before participating in any game or interacting with any other user.

Khelamm reserves the right to suspend, revoke, or deny host status at any time where concerns arise regarding safety, fraud, misconduct, misrepresentation, or violations of these Terms.

7. Nature of the Platform

Khelamm is only a platform that enables users to discover, organize, and participate in community games.

Khelamm:

  • Does not employ hosts

  • Does not employ players

  • Does not supervise games

  • Does not provide referees or officials

  • Does not provide sports facilities

  • Does not guarantee game quality

  • Does not guarantee player conduct

  • Does not guarantee host conduct

All interactions between players and hosts occur entirely at their own risk.

8. Payments and Fees

Khelamm currently does not process, collect, hold, manage, facilitate, or receive payments between users.

Any participation fee is paid directly by players to hosts.

Hosts must provide valid payment methods such as:

  • Cash payments

  • Online payment methods accepted by the host

Collection of participation fees before the game through the Khelamm platform is not permitted.

Khelamm is not a party to any financial transaction between players and hosts and is not responsible for disputes relating to payments, refunds, collections, or financial arrangements.

9. Player Responsibilities

By joining a game, players agree to:

  • Arrive on time

  • Follow host instructions

  • Respect other players

  • Respect venue rules

  • Follow applicable game rules

  • Behave in a sportsmanlike manner

  • Maintain appropriate conduct before, during, and after games

Players must not:

  • Engage in harassment

  • Engage in abusive behavior

  • Use threatening language

  • Use hate speech

  • Engage in discrimination

  • Intimidate or bully others

  • Damage property

  • Cheat or manipulate game results

  • Use illegal substances during games

  • Participate in unlawful activities

Repeated violations may result in suspension or permanent removal from Khelamm.

10. Host Responsibilities

Hosts are solely responsible for organizing and managing their games.

Hosts are responsible for:

  • Booking and securing venues or grounds

  • Ensuring venue availability

  • Providing necessary equipment and kits

  • Providing match balls and game materials

  • Arranging referees or officials when applicable

  • Communicating game details accurately

  • Managing participant attendance

  • Maintaining a safe playing environment

  • Informing participants of cancellations or changes

Hosts must not:

  • Misrepresent game details

  • Create fraudulent listings

  • Collect unauthorized fees

  • Engage in deceptive conduct

  • Harass participants

  • Abuse platform features

Khelamm may suspend or permanently remove hosts who repeatedly violate these Terms or receive credible reports of misconduct.

11. Cancellations

Cancellation by Players

A player may leave a joined game only up to twenty-four (24) hours before the scheduled game start time.

After this period, the player may be marked as a no-show if they fail to attend.

No-Shows

Players who fail to attend games without proper cancellation may receive a no-show flag.

Repeated no-shows may result in:

  • Temporary restrictions

  • Account suspension

  • Permanent removal from the platform

Cancellation by Hosts

Hosts may cancel games for legitimate reasons including:

  • Insufficient player participation

  • Adverse weather conditions

  • Unsafe playing conditions

  • Venue unavailability

  • Other hazardous or unforeseen circumstances

Hosts must provide a valid reason for cancellation through the platform.

Force Majeure and Unforeseen Events

Neither Khelamm nor hosts shall be liable for cancellations or disruptions caused by events beyond reasonable control, including:

  • Severe weather

  • Natural disasters

  • Earthquakes

  • Floods

  • Government actions

  • Public emergencies

  • Civil unrest

  • Other hazardous conditions

Refunds

Because Khelamm does not process or collect payments, any refund discussions or arrangements are solely between the host and participating players.

Where a game is cancelled after payments have been collected at the venue, the host is solely responsible for determining and managing any applicable refunds.

12. Injuries and Assumption of Risk

Participation in sports and physical activities involves inherent risks, including:

  • Physical injury

  • Illness

  • Disability

  • Property damage

  • Serious bodily harm

  • Death

By participating in any game listed on Khelamm, you acknowledge and voluntarily accept these risks.

You are solely responsible for determining whether you are physically fit to participate.

You participate entirely at your own risk.

13. Release and Limitation of Liability

To the fullest extent permitted by applicable law in Nepal, Khelamm provides a technology platform that enables users to discover, organize, host, and participate in community sports and recreational activities.

Khelamm does not organize, operate, supervise, manage, control, endorse, or participate in any games, events, activities, venues, or interactions between users. Hosts, players, venue operators, and other participants act independently and are solely responsible for their own conduct, decisions, actions, safety, and compliance with applicable laws and regulations.

No Responsibility for User Activities

Khelamm shall not be responsible or liable for any loss, damage, injury, claim, dispute, cost, or expense arising from or relating to:

  • Participation in games, events, or activities arranged through the Services

  • Injuries, accidents, illness, death, or other health-related incidents

  • Damage to, theft of, or loss of personal property

  • Acts, omissions, negligence, or misconduct of users or third parties

  • Disputes between users

  • Cancellations, schedule changes, venue issues, or no-shows

  • Information, content, or communications provided by users

  • Financial arrangements or informal agreements between users

  • Unauthorized access to accounts or user data beyond Khelamm’s reasonable control

  • Interruption, delay, or failure of the Services

No Payment Responsibility

Khelamm does not collect participation fees, process payments, or act as a party to any financial arrangement between users. All payments, reimbursements, refunds, and cost-sharing arrangements are strictly between users.

Khelamm shall not be responsible for any payment disputes, refund issues, or financial losses arising from such arrangements.

Limitation of Liability

To the maximum extent permitted by applicable law, Khelamm shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses resulting from or related to your use of the Services.

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law.

14. Community Standards

Users must treat all participants with respect.

The following conduct is prohibited:

  • Harassment

  • Bullying

  • Threats

  • Hate speech

  • Discrimination

  • Violence

  • Fraud

  • Impersonation

  • False reporting

  • Sharing another person's personal information without consent

  • Illegal activities

  • Any conduct that endangers others

Violations may result in immediate suspension or permanent removal without prior notice.

15. Reporting Misconduct

Users may report misconduct, unsafe behavior, fraud, abuse, harassment, threats, illegal activities, or violations of these Terms.

Hosts may report players.

Players may report hosts.

Khelamm may investigate reports and take actions including:

  • Warnings

  • Restrictions

  • Suspensions

  • Permanent account termination

  • Removal of game listings

Khelamm's decisions regarding enforcement are final.

Cooperation with Legal Authorities

Khelamm may preserve, review, and disclose reports, account information, host verification information, communications with support, and other relevant records where required by applicable law or lawful requests from government authorities, courts, law enforcement agencies, or regulatory bodies.

Where legally permitted, Khelamm may cooperate with investigations involving:

  • Fraud

  • Harassment

  • Threats

  • Violence

  • Property damage

  • Criminal conduct

  • Public safety concerns

  • Violations of applicable law

Users acknowledge that reports submitted through the platform may be retained and disclosed when necessary for legal compliance, law enforcement cooperation, dispute resolution, public safety, or protection of Khelamm, its users, or third parties.

16. Removal From Games

Hosts may request that a participant leave a game during play if the participant:

  • Violates game rules

  • Creates safety concerns

  • Engages in abusive conduct

  • Harasses others

  • Violates Khelamm Community Standards

Such actions may also result in disciplinary measures on the platform.

17. Suspension and Termination

Khelamm reserves the right to suspend, restrict, or terminate any account at any time for:

  • Violations of these Terms

  • Fraudulent activity

  • Repeated no-shows

  • Abuse of the platform

  • Community safety concerns

  • Legal or regulatory reasons

Serious violations may result in immediate suspension without prior notice.

Users may appeal a suspension by contacting:

Submission of an appeal does not guarantee reinstatement.

18. Intellectual Property

All rights, title, and interest in the Khelamm platform, including software, branding, logos, designs, content, and related materials, belong to Khelamm.

Users may not copy, modify, distribute, reverse engineer, reproduce, or exploit any part of the Services without prior written permission.

19. Privacy

Use of the Services is also governed by Khelamm's Privacy Policy.

By using Khelamm, you acknowledge that personal information is collected and processed in accordance with the Privacy Policy.

20. Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis.

Khelamm makes no warranties regarding:

  • Availability of games

  • Reliability of hosts

  • Reliability of players

  • Venue quality

  • Safety of participants

  • Accuracy of listings

  • Continuous platform availability

Use of the Services is entirely at your own risk.

21. Account Closure and Data Requests

Users may contact Khelamm regarding account closure or data deletion requests.

Khelamm may retain certain information as required for:

  • Legal compliance

  • Fraud prevention

  • Security purposes

  • Investigations

  • Enforcement of these Terms

22. Changes to These Terms

Khelamm may modify these Terms from time to time.

Updated Terms become effective upon posting on the website or within the applications.

Continued use of the Services after the effective date constitutes acceptance of the revised Terms.

23. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of Nepal.

Any dispute arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the competent courts of Nepal.
